公益诉讼检察调查核实权的功能异化与制度完善

厘清并充分彰显公益诉讼检察调查核实权之应然功能,是推动公益诉讼健康发展的关键举措。根据公益诉讼的发展需要并结合调查核实权的权力性质,公益诉讼检察调查核实权的应然功能应定位于“进行法律监督、调查核实案情、保障公益诉讼”三方面。但公益诉讼检察调查核实权在实践运行过程中,出现“倾向一般监督、调查重于核实、片面追求胜诉”等若干可能的问题以及浪费司法资源等现象。为促进公益诉讼检察调查核实权良好运行,需立法明确权力性质,细化调查核实内容,在检察权体系中有效区分适用该权力。

To promote the healthy development of public interest litigation,it is a key measure to clarify the necessary function of procuratorial power of investigation and verification.According to the needs of public interest litigation and the nature of investigation and verification,the necessary function of procuratorial power in public interest litigation should be oriented towards legal supervision,case investigation and public interest litigation.However,in practice it suffers from function dissimilation,and problems like general supervision,priority of investigation over verification,biased pursuit to win the lawsuit cause infringement of other rights,ambiguous neutrality,waste of judicial resources and other phenomena.In order to promote procuratorial power of investigation and verification in public interest litigation,it is necessary to define the nature of this power by legislation,refine the content of investigation and verification,and effectively distinguish and apply this power in the procuratorial system.
