摘要
改革开放40年来,我国市场竞争环境从相对僵化、低效的传统计划经济向更为灵活、更为高效的市场经济转变。当前,我国进入全面深化改革和推进国家治理体系和治理能力现代化的重要时期,重新梳理政府与市场的关系,准确划定政府行为的竞争边界,对于进一步巩固竞争政策的基础地位、完善社会主义市场经济体制,具有重要的理论和实践价值。政府行为可能因滥用行政权力、政府俘获、信息不足、判断失误等原因,存在偏袒、保护、限制等超越竞争边界的情况,根据配置资源的方式、范围、手段、结果的不同表现出不同的特征。判断政府行为是否超越了竞争边界,可以以行政合法性与合理性原则、尊重市场规律原则、防止不当损害竞争原则、比例原则为标准进行判断。最后,政府行为在资源配置的方式、范围、手段上应该更加审慎。
Over the past 40 years of reform and opening-up,Chinese market competition environment has changed from a relatively rigid and inefficient traditional planned economy to a more flexible and efficient market economy.At present,China has entered an important period of comprehensively deepening reform and promoting the modernization of the national governance system and governance capacity.Reorganizing the relationship between the government and the market,and accurately defining the competitive boundary of government behavior have important theoretical and practical values for further consolidating the basic position of competition policy and improving the socialist market economy system.Due to the abuse of administrative power,government capture,lack of information,misjudgment and other reasons,government behavior may be biased and goes beyond the competitive boundary.To judge whether the government behavior goes beyond the competition boundary,we can take several principles of law for reference and guidance,including the principle of administrative legitimacy and rationality,respecting market law,preventing undue damage to competition and proportionality Finally,the government should be more prudent in the way,scope and means of resource allocation.
