On the Pension Function of Residence Right

《民法典》以法律形式确立了居住权,在保障老年人住房权益方面发挥了重要作用。居住权能促进“老有所居”的实现,在“以房养老”、家庭内部养老以及保障高龄生存配偶居住权益方面发挥了重要作用。为充分发挥居住权的价值,提出了以下四条实现居住权养老功能的路径:防范居住权养老功能减损的潜在风险;丰富居住权取得方式的种类;扩大居住权受益主体的范围;增加居住权的消灭方式。

The Civil Code establishes the right of residence in legal form and plays an important role in protecting the housing rights andinterests of the elderly.The right of residence can promote the rea-lization of"housing for the elderly",and plays an important role inthe"house-for-pension",the internal pension and the protection of the residence rights and interests of the elderly spouse.In order togive full play to the value of the right of residence,this paper pu-ts forward the following four ways to realize the pension function ofthe right of residence:preventing the potential risk of the loss of the pension function of the right of residence;To enrich the varietyof ways to obtain the right of residence;Expand the scope of benefi-ciaries of the right of residence;Added ways to eliminate the right of residence.
