摘要
围绕知识产权中的重要组成部分——著作权的财产属性展开分析,针对大数据背景下著作权权益保护所面临的新挑战,运用法经济学中经典的汉德公式分析了平衡个人效用和社会效益的策略,将社会效益的最优化置于核心目标,讨论了著作权权益保护的预防责任分配以及著作权被侵权后的赔偿问题,并提出相应的著作权权益保护的政策建议。
Focusing on the property attribute of copyright,an important part of intellectual property rights,the paper analyzes the new chal-lenges faced by the protection of copyright rights and interests under the background of big data,analyzes the strategy of balancing individual utility and social benefit by using the classic Hand formula in law and economics,and puts the optimization of social benefit as the core goal.This paper discusses the distribution of prevention responsibility of copyright protection and the compensation after copyright infringement,and puts forward corresponding policy suggestions on copyright protection.
