摘要
文章通过对我国医学伦理建设的发展进程以及伦理审查体系现状进行梳理,对医学伦理法律法规发展概况以及医学伦理相关法律、行政法规、部门规章、部门规范性文件,各省市伦理规范的建立与运行情况进行整理和汇总.对其中存在的缺乏监管、伦理法律内容空白与模糊、治理体系滞后等问题提出意见.从加快法规和法律建设、加强伦理体系建设以及加深全球合作与发展三个方面提出建议:我国应制定"医学伦理审查法",明确医学伦理相关法律的实施细则;建立多部门联动执法协调机制,调整伦理审查流程,加强人员的教育培训以及知识储备;学习借鉴优秀的伦理治理经验,建立完善医学伦理法律体系.
The development process of medical ethics and the status of ethical review system in China were sorted out,and the development of medical ethics laws and regulations,medical ethics related laws,administrative regulations,departmental regu-lations,departmental normative documents,and the establishment and operation of ethical norms of various provinces and cities were summarized.The problems of lack of supervision,blank and ambiguity of ethical legal content,and lagging governance sys-tem were discussed.Based on which,some suggestions were put forward from three aspects of accelerating the construction of reg-ulations and laws,strengthening the construction of ethical system,and deepening global cooperation and development.
