目前,代孕子女监护人的确定仍是以亲子关系为中心的亲属关系规则。该路径围绕亲子关系,维系血缘中心主义的地位,不仅无法适应多元化的生育实践现状,更无法实现未成年利益最大化。代孕子女监护人的确定路径需跳脱出亲子关系的束缚,从代孕子女利益最大化角度重新考量其监护人确定路径,优先以监护意愿为主线,将代孕当事人的经济条件和代孕子女的真实意愿作为辅助参考。在代孕当事人双方均无监护意愿抑或双方监护意愿冲突时,由法院等相关法定机关根据相关当事人的经济条件和代孕子女意愿综合确定代孕子女的监护人,并让其他非监护人的代孕当事人承担一定的监护监督义务和抚养义务,同时赋予其探望权,以保证代孕子女利益的最大化。

At present, the guardians of surrogate children are still determined around kinship rules centered on parent-child relationship. This pathway, which revolves around the parent-child relationship and maintains the status of blood-centralism, not only fails to adapt to the current diversified fertility practices, but also fails to maximize the interests of minors. The pathway to determine the guardians of surrogate children needs to get out of the shackles of the parent-child relationship, therefore, it should be reconsidered in order to maximize the interests of the surrogate children. Priority should be given to the guardianship willingness, while the economic conditions of the surrogate parties and the true willingness of the surrogate children should be taken as an auxiliary reference. In cases that both parties to the surrogacy have no willingness or their guardianship desires conflict, the court and other relevant statutory authorities shall comprehensively determine the guardians of the surrogate children according to the economic conditions of the relevant parties and the willingness of the surrogate children, and let other non-guardian surrogate parties undertake certain obligations to supervise and bring up, and at the same time, grant them visitation rights to ensure the maximization of the interests of surrogate children.
