环境法典的体系定位与规范结构——基于宪法与环境法立法交互逻辑的证成

The System Character and Normative Structure of the Environmental Code——Deduction and Reasoning of the Legislative Interaction Logic of the Constitution and the Environmental Law

在依宪治国的要求下,根据宪法调控是环境法典编纂的首要要求。在宪法和部门法交互影响的背景下,宪法与环境法的立法交互逻辑内含对环境法法典化的规范要求,环境法典对宪法环境保护与治理功能的整体承载,决定了环境法典作为环境宪法实施法的体系定位。在方法论上,环境法典编纂既要在环境宪法秩序中寻找概念体系、规范体系与价值体系的内在限定,形成逻辑自洽、边界清晰的主体结构,又要对宪法规范在环境法典中的规范属性、保护义务与表达构造进行正确转介,明确宪法规范纳入环境法典的合理形式。为充分实现环境法典交互宪法的制度性效益,环境法典应当围绕环境宪法规范展开教义学分析,对总则编、污染控制编、自然生态保护编、绿色低碳发展编、生态环境责任编的逻辑主线和规范内容进行制度性展开,保障环境法典的合宪性与实践性。

The compilation of the Environmental Code by the Constitution is the first basic requirement under the goal of governing the country according to the Constitution. The interaction of the Constitution and the environmental laws contains the demands for the codification of the environmental law. As the environmental constitution implementation law, the Environmental Code absorbs the Constitution’s environmental function. The code should not only seek the internal limitations of the conceptual system, normative system and value system, but also form a self-consistent and clear-cut main structure. Protection obligations and expression constructs of the Constitutional norms should be incorporated and clarified in the code. The code should use a doctrinal analysis to analyze the whole five parts. The logical line and normative contents are systematically developed to realize the constitutionality and practicality of the Environmental code.
