论全过程人民民主制度化的法治保障

On the Legal Guarantee of the Institutionalization of the Whole-Process People’s Democracy

全过程人民民主是党的二十大报告重点论述的内容之一,推进全过程人民民主的制度化必须借助法治的保障。民主无论是作为人民当权的国家制度、人民当家作主地位的显现,还是表现为法律规定的权利以及合理的诉求表达,都需要在法治的机制中得以型构。人民代表大会制度、中国共产党领导的多党合作和政治协商制度、民族区域自治制度、基层群众自治制度是全过程人民民主主要的制度载体,协商民主则是实践全过程人民民主的重要形式,体现于各种民主制度的运行过程之中。正确理解和运行全过程人民民主,要祛除人治因素的不良影响,防范“大民主”型的反民主建制,同时尊重少数人的权利和利益。

The whole-process people’s democracy is an important statement emphatically made in the Report to the 20^(th) CPC National Congress.The promotion of the institutionalization of the whole-process people’s democracy relies on the legal guarantee.Democracy must be shaped and constructed under the mechanism of the rule of law,whether it is a state system in which the people hold power,a presentation of the status of the people as the masters of the country,or a demonstration of the people’s rights stipulated by law and their reasonable demands.The system of people’s congress,the system of CPC-led multiparty cooperation and political consultation,the system of regional ethnic autonomy,and the system of community-level self-governance,constitute the main institutional vehicles of the whole-process people’s democracy.Consultative democracy is an important form to practise the whole-process people’s democracy,which is embodied in the process of operating various democratic systems.To correctly understand and practise the whole-process people’s democracy,we must eliminate the adverse influence made by such a factor as the rule of man,take precautions against the“great democracy”type anti-democratic organizational system,and respect the rights and interests of the minority of the people.
