摘要
我国目前无论是《行政诉讼法》还是有关司法解释,抑或是各地方的行政程序规定都是以正面列举加法律授权的形式来明确行政协议的缔结范围,这种保守型的立法所确立的严格的合法性容许标准不仅难以满足社会实践中对行政协议的广泛需要,也难以有效地规制行政权力的恣意,还是造成当下司法实践中行政协议案件认定混乱的根源。因此,我国宜确立较为开放的法定性排除标准,并通过综合考量政府职能的性质,划定行政协议缔结范围的禁区。凭借行政事务的内在属性,确定出某些重要的政府职能,禁止行政协议的缔结。而对于其他行政事务则应秉持开放的态度,允许缔结行政协议。
At present,Administrative Procedure Law associated judicial interpretations and local administrative procedure regulations in China all define the conclusion of administrative agreement’s scope in the form of enumeration and legal authorization.The standard of legitimacy established via this conservative legislative method not only can hardly meet the extensive needs of administrative agreement in social practice,but also fail to effectively regulate the abuse of administrative power.Moreover,it is also the source of the confusion in the identification of administrative agreement cases in the judicial practice.Therefore,this paper suggests that China might establish a more open exclusion standard,and delimit the restricted area of the contracting scope of administrative agreement by comprehensively considering the nature of government functions.In addition,according to the inherent nature of administrative affairs,determine some momentous government functions and prohibit the conclusion of administrative agreements.But for other administrative affairs,we should hold an open attitude and permit the conclusion of administrative agreements.
