On the Strategic Positioning, Practical Development, and Future Prospects of a Government of Law Construction in the New Era

法治政府建设是四个全面战略布局的重要组成部分,是全面依法治国的主体工程。党的十八大以来法治政府建设率先突破,依法行政制度体系渐趋完备、严格规范文明执法得到加强,行政决策的民主化、科学化、法治化进步明显,政务公开走向数据开放,预防和化解争议的法治化格局正在形成。党和国家机构改革、放管服改革、监察体制改革的成效显著并为法律所固化。将职能科学、权责法定、执法严明、公开公正、智能高效、廉洁诚信、人民满意的法治政府推向深入,需要从制定行政基本法典、全面落实法治政府实施纲要、将全过程人民民主融入法治政府建设全领域、推动数字政府和法治政府深度融合、全面重构应急制度体系,实现常态行政和应急行政的无缝衔接五个方面着力。

The construction of a government of law, constitutes an important part of the Four-Pronged Comprehensive Strategy, and is the principal project to advance Law-Based Governance. Since the Party’s 18 th National Congress, the efforts to build up a government of law have spearheaded a major breakthrough, the law-based administrative system has progressively ameliorated, law enforcement has taken on an increasingly rigorous, procedure-based and civilized manner, the administrative decision-making has stepped steadily forward to a more democratic, scientific and law-based process, the transparency of government affairs is steering toward data opening, and the landscape of rule of law is shaping up for the prevention and resolution of disputes. Fruitful results have been reaped and consolidated by legislation in three significant reforms, namely, the Institutional Reform of the Party and State, the Reform to Streamline Administration by Delegating Power, Improving Regulation, and Upgrading Governmental Services, and the Reform of the National Supervision System. To further advance the construction of a government of law towards a government with scientific divisions of functions, with statutory powers and responsibilities, with rigorous and informed law enforcement, a government of openness, impartiality, intelligence, efficiency, integrity, honesty, and of people’s content, more efforts shall be made in five crucial aspects, inter alia, formulating an administrative basic code, fully implementing the Outline of Constructing a Government of Law, integrating the whole-process of People’s democracy into the government of law construction on all fronts, promoting an in-depth integration of digitalization and government of law construction, and thoroughly restructuring the emergency system to realize a seamless transition between administration in normal and emergency circumstances.
