摘要
宅基地“三权分置”理论作为中央政策文件指导的重要改革指导,仍旧处于探索阶段,最终目标是建立一套切实有效的法律制度。分析学界的理论研究和试点的实践经验,探讨宅基地所有权、资格权和使用权的法律内涵,能为“三权分置”制度的构建提供理论基础。选取浙江义乌和贵州湄潭两地的改革模式进行研究,发现宅基地“三权分置”的理论进步,通过对比分析优缺点,指出存在的问题并提出解决思路。
As an important reform guideline guided by the central policy documents, the theory of "three rights of separation" of residential bases is still in the exploration stage,and the ultimate goal is to establish a practical and effective legal system. Analyzing the theoretical research and practical experience of pilot projects,we explore the legal connotation of ownership,qualification and use of residential land,which can provide a theoretical basis for the construction of the system of "separation of three rights". The reform models of Yiwu, Zhejiang Province and Meitan, Guizhou Province are selected for study to discover the theoretical progress of the "three rights of separate ownership" of residential bases,and through comparison and analysis of the advantages and disadvantages,problems are pointed out and solutions are proposed.
