Analysis of Management Problems and Countermeasures in China's Digital Music Market--Taking"Exclusive Copyright Agreement"as an Entry Point

中国数字音乐版权市场经历了“盗版时代”、“付费版权时代”、再到“独家版权时代”,基于市场变化情况,国家主要采取了约谈、出台通知以及行政处罚等强制力较强的手段进行市场监管和调控。本文通过对独家版权协议的法律性质进行辨析,分析其对数字音乐版权市场造成的多重影响,以此厘清独家版权在数字音乐版权市场发展中的历史意义;同时结合对域外合理经验的考察,探析我国著作权集体管理组织市场缺位原因。针对上述数字音乐市场的管理问题,提出了以下建议:发挥国家政策引导作用、加强对集体管理组织的监督;此外,健全法律制度设计、升级技术管理数据系统,以弥补行政资源的不足,从而形成一套完整的数字音乐版权市场管理体系。

China's digital music copyright market has experienced the"piracy era",the"paid copyright era",and then the"exclusive copyright era".Based on the changes in the market,China has mainly adopted such strong measures as interviews,notices and administrative penalties to regulate the market.This paper analyzes the legal nature of exclusive copyright agreements and the multiple impacts on the digital music copyright market,so as to clarify the historical significance of exclusive copyright in the development of the digital music copyright market;at the same time,it also explores the reasons for the lack of a collectiv e copyright management organization in China's market by examining the reasonable experiences of foreign countries.To solve the above problems of digital music market management,the following suggestions are put forward:Firstly,the government should provide effective guides and strengthen the supervision on digital music market.In addition,in order to make up the lack of administrative power,the legal system and the data management system should be further improved.In the end,a sound set of digital music copyright market management system will be established.
