Systematic Observation of National Security Information

[目的/意义]旨在推动情报学与法学的跨学科研究在国家安全领域的开展,通过一个抽象力和解释力足够强的理论工具来观察两者之间的关系和互动。[方法/过程]通过运用卢曼的社会系统论工具来观察情报系统的生成环境和生成形态,并通过与法律系统在结构上的耦合来观察《国家情报法》的反思路径。[结果/结论]情报系统与法律系统作为共同解决国家安全问题的机制,承担对现代风险社会的复杂性化约任务。情报系统与法律系统基于变化、选择以及稳定的模式实现结构耦合,并通过二阶观察方式在组织和程序上反思《国家情报法》的制定,以此提高二者间的契合度及第三方的认知与理解程度。

[Purpose/significance] The paper is to promote the interdisciplinary study of intelligence science and law in the field of national security,and observe the relationship and interaction between the two through a theoretical tool with sufficient abstraction and explanatory power. [Method/process] It observes the generative environment and form of intelligence systems by using Luhmann’s tools of social systems,and observes the reflection path of the National Intelligence Law through structural coupling with the legal system. [Result/conclusion] As a mechanism to solve national security problems together,the information system and the legal system undertake the task of reducing the complexity of the modern risk society. The intelligence system and the legal system are structurally coupled based on the patterns of change,choice,and stability,and reflect on the organization and procedure of the enactment of National Intelligence Law through the second-order observation,so as to improve the compatibility between the two and the awareness and understanding of the third party.
