机动车在信号灯控制路口“闯红灯”与“不按导向车道行车”违法行为的认定分析

驾驶机动车在交通信号灯控制路口“不按交通信号灯指示通行”(简称“闯红灯”)和“不按规定导向车道行车”(简称“不按导向车道行车”)是两种不同的道路交通违法行为。在设有左转专用车道和直行专用车道、道路交通信号灯多相位控制的交叉口,驾驶人对机动车在不同信号灯色组合情形下在“左转车道直行”或在“直行车道左转”被认定为“闯红灯”存在争议,因为涉及记6分的处罚,多地出现申诉案例。本文从法律规范、法理依据两方面对两种违法行为进行了分析,提出了明确的认定方法。

The driver drives a motor vehicle"not abiding by traffic lights"(hereinafter referred to as"run-red-light")and"not following the prescribed guiding lane"(hereinafter referred to as"not following the guiding lane")at the signalized intersection are two different road traffic violations.At intersections with exclusive left turn lanes,straight lanes and multi-phase control of traffic lights,drivers have disputes over whether the going straight behavior in the"left turn lane"or the turning left behavior in the"straight lane"under different combinations of signal light colors can be recognized as"run-red-light".Because these behavior involves a penalty of 6 points,there are many appeals filed.This paper analyzes these two kinds of traffic violation behaviors from aspects of legal norms and legal basis,and puts forward clear identification methods.
