Theoretical Differences and Coordinated Management Measures for Parallel Importation of Trademarks

平行进口问题在商标权、专利权、著作权等领域中广泛存在,是一个涉及知识产权和国际贸易的热点话题,并且在商标领域的平行进口问题尤为突出。随着经济全球化和贸易自由化进程的加快,涉及商标平行进口的案件越来越多,探讨商标平行进口问题对我国对外贸易有着十分重要的意义。本文通过商标平行进口的概念、特征与成因进行研究,分析商标平行进口中存在的矛盾与冲突,对商标平行进口的问题作初步探讨,并并提出了符合中国国情的相应措施。

The issue of parallel importation exists widely in the fields of trademark,patent and copyright,and is a hot topic involving intellectual property rights and international trade,and the issue of parallel importation is particularly prominent in the field of trademark.With the acceleration of economic globalization and trade liberalization,there are more and more cases involving parallel importation of trademarks,and it is of great significance to explore the issue of parallel importation of trademarks for China's foreign trade.This paper examines the concept,characteristics and causes of parallel importation of trademarks,analyses the contradictions and conflicts in parallel importation of trademarks,makes a preliminary discussion of the problems of parallel importation of trademarks,and proposes corresponding measures in line with China's national conditions.
