“规范体系”构建何以可能:中国古代社会秩序多元稳定性的历史证成

How Is It Possible to Build a “Normative System”?——Historical Proof of the Pluralistic Stability of Ancient Chinese Social Order

中国古代社会的治理模式呈现着秩序格局多元化的历史事实。法律制度不是构成国家治理规范体系的唯一权威话语,凡是能够在特定领域中发挥引导社会活动开展作用的显、隐性规则,都可以作为构建一国治理格局基本秩序的规范体系。中国在近代西学传入以及本土政治哲学理论进行自新意义的完全蜕变之前,其规范体系呈现着多元且稳定的运行态势。本文围绕“中国古代规范体系的基本构成”“规范体系结构的社会历史成因”“规范体系子单元关联性的逻辑解构”三个层面,凸显中国古代社会秩序多元却又极具稳定性的显著特点,尝试搭构其“规范体系”构建的历史范本。

The governance model of ancient Chinese society presents the historical fact that the order pattern is diversified. The legal system is not the only authoritative discourse that constitutes the normative system of national governance. The explicit and implicit rules that can play a role in guiding social activities in specific fields can be used as the normative system for constructing the basic order of a country’s governance structure. Before the introduction of Western learning in modern times and the complete transformation of the local political philosophy theory, its normative system presented a diversified and stable operation. This article focuses on the three aspects of “basic composition of the ancient Chinese normative system”, “the social and historical causes of the normative system structure”, and “logical deconstruction of the correlation of the subunits of the normative system”, highlighting the characteristics of remarkable diversity and stability of the ancient Chinese social order, and trying to construct a historical model for the construction of its “normative system”.
