公交地方立法现状及新形势下立法建议--以国内五大城市为例

The Present Situation of Local Legislation of Bus Tram and the Legislative Suggestions Under Some New Situations:Taking Five Typical Cities in China as an Example

为规范和引导地面公交健康发展,各地根据国家上位法和城市各自特点,制定地面公交的地方性法规。当前,地面公交管理和发展面临许多新情况,如公交都市建设要求提高、国家“双碳目标”确立、公共安全和卫生防控升级等,因此地方性法规也面临进一步完善的需要。在此背景下,文章选取国内五个典型城市(上海、杭州、深圳、南京、成都),梳理并分析各地的地方性法规主要内容,提炼立法重点和方向,为其他城市相关立法、修法提供参考,同时根据地面公交发展的新形势新情况,提出完善地方性法规的相关建议。

In order to standardize and guide the healthy development of bus tram,local laws and regulations of bus tram are formulated according to the national law and the characteristics of each city.At present,the management and development of bus tram are facing many new situations,such as the higher requirements of public transportation metropolis,the establishment of carbon peaking and carbon neutrality goals,the upgrading of public safety and health prevention and control,so the local laws and regulations are also facing further improvement.In the above context,the paper selected five typical cities(Shanghai,Hangzhou,Shenzhen,Nanjing,Chengdu),taking their local regulations for bus tram as an example,analyze the main content of the regulations,and refine the legislative focus and direction of five cities,hoping to provide reference for other cities,and put forward relevant suggestions for improving local laws and regulations according to some new situations.
