中国式现代化公共法律服务理论论纲

OUTLINE OF THE THEORY OF PUBLIC LEGAL SERVICE THROUGH A CHINESE PATH TO MODERNIZATION

当代中国社会治理实践的法治经验和本土资源生成了逻辑严密、科学完备的中国式现代化公共法律服务理论。这一理论是习近平法治思想的组成部分,对于推进公共法律服务制度体系建设与加强社会治理法治建设具有重大的理论创新和改革实践创新指引及制度创新的指导意义。公共法律服务概念诞生于我国推进全面依法治国和建设服务型政府同频共振的新时代背景下,逐步从一个完整的原创性本土资源法治概念,发展成一个相对完整的基层社会治理体系制度建构,进而成为实质意义破解基层社会矛盾纠纷化解难题的主要法治方法、法治道路和法治建设路径。中国式现代化公共法律服务理论源自“公共性”“公共服务”与中国社会治理实践相结合的时代发展背景,形成于当代中国特色社会主义基层社会治理改革实践探索之中,对于坚持在法治轨道上推进国家治理体系和治理能力现代化发挥着重要的引领功用。

The rule of law experience and local resources of contemporary Chinese social governance practice generate the logically rigorous and scientifically complete theory of public legal service through a Chinese path to modernization,which is the component of Xi Jinping Thought on the Rule of Law and has a great guiding significance of theoretical innovation,reform practice innovation and system innovation to promote the construction of public legal service system and strengthen the rule of law construction of social governance.The concept of public legal service was born under the new era background of comprehensively advancing law-based governance and constructing the service-oriented government with the same frequency resonance.It has gradually developed from a completely original concept of the rule of law of local resources into a relatively complete institutional construction of grassroots social governance system,and then become the main method,the road and the construction path of the rule of law to solve social contradictions and disputes at the grassroots level in essence.The theory of public legal service through a Chinese path to modernization originates from the development of‘publicity’and‘public service’combined with the social governance of China.It is formed in the practice and exploration of contemporary socialist grassroots social governance reform with Chinese characteristics.It plays an important guiding role in promoting the modernization of China’s governance system and capacity along the path of the rule of law.
