乡村振兴背景下乡村自治制度的创新路径探析

Study of Innovative Paths of Rural Autonomy System Under the Background of Rural Revitalization

乡村自治制度是我国基层民主制度建设的伟大实践,亦是全过程人民民主的重要体现,乡村振兴战略为乡村自治提供了新的历史发展机遇。当前,我国对乡村自治的理论和实践探索已经取得了一定的成效。但随着新发展阶段新问题和新挑战的不断显现,不论是从实体层面还是从程序层面,现行乡村自治制度面临一些困境,存在主体权限不清、法律关系错位、规则设计弹性大、程序性机制阙如等问题,难以真正助力乡村振兴。借鉴国外乡村自治相关经验,着重从立法完善、主体定位、程序强化等方面破解当前我国乡村自治的制度困境,是在乡村振兴背景下推进乡村自治的有效路径。

The rural autonomy system is a great practice in the construction of the grass-roots democratic system in China,and also the important reflection of whole-process people’s democracy.The rural revitalization strategy provides a new historical development opportunity for rural autonomy.At present,China has achieved certain results in the exploration of theory and practice of rural autonomy.However,with the constant appearance of new problems and challenges in the new stage of development,either at the level of entity or at the level of procedure,the present rural autonomy system faces some dilemmas such as the subject’s unclear privilege,misplacement of legal relation,greater elasticity of rule design and lack of procedural mechanisms,which is difficult to help rural revitalization really.By using the relevant experience of rural autonomy for reference in other countries,we can solve the current institutional dilemmas of China’s rural autonomy from the aspects of legislation improvement,subject orientation,and procedure enforcement,etc.
