城市更新背景下老旧社区法治化治理的路径探索

Path Exploration of Legalized Governance of Old Communities under the Background of Urban Renewal

社区治理,是实现国家治理体系和治理能力现代化的基础性工程。老旧社区的更新改造作为城市有机更新的一项重要项目,是建设宜居城市的一项民生工程。基于城市更新的背景,探讨老旧社区改造实行法治化治理的必要性,审视当前老旧社区改造所面临的问题,有法律层面缺乏完备的规范体系、居民自治意识不足、法律专业性人才的遗乏、法治环境的欠缺、治理手段的老旧化等问题。通过探讨成都市老旧社区改造成功的案例,吸收借鉴其法治化治理的手段,通过加强党的领导、完善社区自治规范体系、加强法治氛围的培养以及创新治理模式四个方面提升老旧社区的治理水平,实现法治化治理。

Community governance is a fundamental project to modernize the national governance system and governance capacity.As an important project of urban organic renewal,the renewal and transformation of old communities is a livelihood project for building livable cities.Based on the background of urban renewal,this paper discusses the necessity of implementing the rule of law in the renovation of old communities,and examines the current problems faced by the renovation of old communities,such as the lack of a complete normative system at the legal level,the lack of residents,self-government awareness,and the lack of legal professionals,the lack of the rule of legal environment,the aging of governance means and other issues.Through strengthening the party's leadership,perfecting the normative system of community autonomy,strengthening the cultivation of legal atmosphere and innovating the governance model four aspects to improve the governance level of old communities and realizetheruleof law.
