论我国著作权集体管理许可使用费决定机制的完善

Study on the Perfection of the Mechanism of Licensing Royalties for Collective Copyright Management in China

文章认为,我国著作权集体管理许可使用费决定机制的强制性色彩浓厚,不利于发挥著作权制度的激励功能,有必要进一步保证相关权益人的知情参与权、确保许可使用费标准的普适性与包容性。首先在确定收费标准的过程中应不断提高制定程序和制定依据的科学性、透明性,综合考量各种因素,并在法律规定中加以明确;其次,也应贯彻实施自由协商原则,建立起“收费标准”与“自由协商”平行选择适用的决定机制;最后,应专门配备切实可行的救济措施,以平衡集体管理组织和其他当事人的权益,确保许可使用费的公平合理。

It’s argued that the mechanism of licensing royalties for collective copyright management is predominantly mandatory,which is not conducive to giving full play to the incentive function of the system.Thus,it is necessary to further safeguard the right to informed participation of relevant stakeholders and ensure the universality and inclusiveness of the royalty standards.First of all,the scientific and transparent nature of the fee-setting procedure and basis should be continuously improved,and various factors should be taken into account and specified in legal provisions;Secondly,the principle of free negotiation should be adhered to and a mechanism for parallel selection of“charging standards”and“free negotiation”should be set;Third,practical relief measures should be provided to balance the rights and interests of organizations and other parties so as to ensure the fairness and reasonableness of royalties.
