Research in Perfection of the Individual Information Protection Mechanism in Big Data Investigation

大数据侦查对个人信息进行海量的收集以及深度的利用带来了一系列的现实风险,集中表现为侦查模式的转型加剧了个人信息侵害风险;侦查权限的扩张引发个人信息泄露风险;侦查信息的共享催生个人信息流转风险。在理论层面通过相关法律原则来明确构建方向,如程序正当原则、比例原则、区别保护原则等。在此基础上构建个人信息保护机制,主要从规定大数据侦查的运行机制以及明确信息主体的权利两方面着手。

Real risks are arising during the big data investigation due to the vast collection of individual information and its deep utilization,especially the risk of privacy infringement aggravated by the new investigation method,the risk of individual information leakage caused by the abuse of investigative power,the risk during individual information transfer in the purpose of sharing the investigation.In theory,the relevant legal doctrines,such as principle of proper procedure,principle of proportion,principle of differential protection,determine the oriental structure.In accordance with it,the individual information protection mechanism is built mainly from regulating the operation of big data investigation and identifying the rights of information owner.
