我国巡回法庭制度建设的理论与实践探析

On the Theory and Practice of the Circuit Court System Construction in China

本文以最高人民法院巡回法庭制度的政策分析为主题,通过文献研究与实地访谈,对国内外巡回法庭制度进行比较研究,从完善司法理念阐释、加强地方司法机构制约监督、探索与完善司法运行理论三个方面探讨了我国巡回法庭制度建设的理论价值;分析了我国巡回法庭制度的实践运行现状,并从完善巡回工作制度保障、培育司法人员内生性价值认同、深化法院审级职能定位改革、疏解巡回法庭信访压力等四个方面提出了进一步完善我国巡回法庭制度的建议。

Following the policy analysis of the circuit court system of the Supreme People's Court,through literature research and field interviews,a comparative study of the circuit court system at home and abroad;this paper discusses the theoretical value of the circuit court system construction in China from the following three aspects:perfecting the interpretation of judicial concept,strengthening the restriction and supervision of local judicial institutions,exploring and perfecting the theory of judicial operation;and analyzes the practical operation status of the circuit court system in China.This paper puts forward suggestions to further improve the circuit court system in China from four aspects:perfecting the circuit work system guarantee,cultivating the endogenous value identification of judicial personnel,deepening the reform of the function orientation of court trial level,and relieving the pressure of circuit court petition.
