打拐行动下妇女权益保障的困境与破局——以丰县生育八孩女子案为例

The Dilemma of the Protection of Women’s Rights and Interests and Its Solution in the Anti-trafficking Campaign--A Study on the Case of the Mother of Eight in Fengxian County

中国现行法律对妇女的人格权、人身自由权和婚姻继承权等权益均有相关法条保障,但当前妇女的权益保障仍然面临诸多挑战,拐卖和收买妇女等行为使妇女的人格尊严、人身安全和精神受到极大的伤害。在此背景下,结合国家深入推进打拐工作的各项举措,从实行买卖同罪、创新侦查模式和完善打拐行动后续联动机制等3个方面完善妇女权益保障措施。

While there are relevant legal terms to protect women’s rights and interests such as personality rights,the right to personal freedom,and the right to matrimonial inheritance,the protection of women’s rights and interests is still faced with many challenges.The trafficking in women brings remarkable harms to women’s personal dignity,personal security and mentality.In view of this situation,based on the measures of the national anti-trafficking campaign,the paper suggests improving the protection of women’s rights and interests from three aspects,namely criminalizing both sides of the trafficking,innovating on the detective mode,and perfecting the follow-up linkage mechanism of the anti-trafficking campaign.
