摘要
国际商事专家委员会是“一带一路”背景下中国司法领域的突破性创新,弥补了国际商事法庭单纯由中国法官审判的不足,为“一站式”争议解决机制提供了支持与保障。但由于《国际商事专家委员会工作规则(试行)》内容较为原则,专家委员依据该规则进行调解、提供域外法律查明和国际商事法庭发展意见时可能会陷入是否合规的困境。为纾解困境,不仅须明确该委员会的性质是法院系统提供专业法律服务的辅助性机构,而且,还应在细化具体程序的基础上,探索专家委员参与庭审活动的可行性,增加专家委员的聘任程序和监督程序,保证专家委员的独立性、公正性和专业性,在打造特色化的国际商事争议解决机制过程中,为中国参与全球治理提供法治保障。
The International Commercial Expert Committee is a breakthrough innovation in China’s judicial field under the background of “the Belt and Road”. It helps to make up for the inadequacy of International Commercial Courts trials being conducted solely by Chinese Judges, to provide support and guarantee for the “one-stop” dispute resolution mechanism, and to strengthen the exchange and cooperation on international commercial dispute settlement. Due to the rather principled content of the Working Rules of the International Commercial Expert Committee of the Supreme People’s Court(For Trial Implementation),the expert members may fall into the dilemma of compliance when performing mediation, providing external legal identification and opinions on the development of international commercial courts. To alleviate the dilemma, it is necessary to clarify the nature of the committee to be professional legal services for the court system, and on the basis of refining the specific procedures for expert members,to explore the feasibility of expert committee to participate in trial activities, to stipulate the procedural rules of hiring and supervising expert members, to ensure the independence, impartiality and professionalism of the experts. All in all, in the process of creating characteristic international commercial dispute resolution mechanism, we should spare no efforts to provide legal guarantee for China’s participation in global governance.
