数字政府建设离不开技术、数据、治理三个要素,未来数字政府会有更丰富的内涵与外延。数字政府是实现法治政府的有效路径,但从传统政府到数字政府的变革过程已对现有的行政法治框架提出了挑战。行政方式的自动化趋势,行政程序的优化、贬损以及平台建设公私合作引发责任分配问题均对现有行政法治带来了深刻影响。数字政府建设应当以法治为首要价值取向,寻求公众参与原则的回归。平台建设引入市场机制的同时应当明确政企合作模式下的法律关系并厘清政企双方的权利义务。未来,可以在行政法典编撰工作中对数字政府实践作出立法回应。

The construction of digital government is inseparable from technology,data and governance.In the future,digital government will have a broader connotation and extension.Digital government is an effective way to realize the rule of law government,but the transformation process from traditional government to digital government has challenged the existing administrative rule of law framework.The trend of administrative automation,the optimization and derogation of administrative procedures,and the responsibility allocation problems caused by public-private cooperation in platform construction all have a profound impact on the existing administrative rule of law.The construction of digital government should take the rule of law as the primary value orientation and seek the return of the principle of public participation.While introducing market mechanism into platform construction,the legal relationship under the cooperation mode between government and enterprise should be clarified and the rights and obligations of both sides should be clarified.In the future,legislative response to digital government practice can be made in the compilation of administrative code.
