王宠惠的国际法思想及实践探析

王宠惠是中国近代史上一位杰出的国际法学家。针对国际法,他提出了诸多重要的主张和看法。他认为国际法存在诸多不足之处,但可通过比较研究各国法律、参与国际比较法学会议和加强对国际私法的研究等方式加以弥补;国际法能够处理国际争端,避免战争发生以维护世界和平,但需组织一个强有力的国际法庭方能达到目的;主权国家依据国际法的规定享有一定的权利并要履行相应的义务。为了使国际法真正发挥维护国际秩序的作用,王宠惠积极参与国际法的修订,为推动国际法的完善和发展作出了贡献。

Wang Chonghui is an outstanding international jurist in the modern history of China.He put forward many important propositions and views on international law.He believes that there are still many shortcomings in international law,but they can be made up by comparative study of the laws of various countries,participation in international comparative law conferences,and strengthening the study of private international law.He also pointed out that international law can handle international disputes,avoid wars and maintain world peace,but it needs to organize a strong international tribunal to achieve its goal.In addition,he also believes that sovereign states enjoy certain rights and fulfill corresponding obligations in accordance with the provisions of international law.In order to make international law truly play the role of maintaining international order,Wang Chonghui actively participated in the revision of international law and made important contributions to the improvement and development of international law.
