包容审慎监管:数据交易的平台监管进路研究

数字经济进入数据资源创新驱动的新时代,数据已然成为一种独立的生产要素并在经济社会生活中发挥着巨大的价值。加快培育数据要素市场,促进数据自由流通,是经济发展、社会创新的必然要求。数据交易平台是实现数据供需双方高效对接和数据资源汇聚流通的重要载体,亦承担着监管职责与义务,但如何落实平台的监管义务,却是学术界和实务部门所面临的难题。“包容审慎”监管作为中国政府在“互联网+”新业态背景下所提出的一项创新性监管原则,与数据交易风险性和创新性并存的特征高度契合。平台对数据交易的监管应以“包容审慎”为原则,既要对数据来源和数据质量实行包容性监管,又要对数据安全和交易主体实行审慎性监管,以实现维护交易安全和实现数据自由流通的双重价值目标。

Digital economy has entered a new era driven by the innovation of data resources. data has become an independent factor of production and plays a huge value in social and economic life. Speeding up the cultivation of data factor market and promoting the free circulation of data are the inevitable requirements of economic development and social innovation. Data trading platform is an important carrier to achieve efficient docking between data supply and demand sides and the convergence and circulation of data resources. It also bears the responsibilities and obligations of supervision. However, how to implement the platform’s regulatory obligations is a difficult problem faced by the academic and practical departments. “Inclusive and prudent” regulation, as an innovative regulatory principle proposed by our government in the context of the new format of “internet plus”, is highly consistent with the characteristics of the coexistence of risk and innovation of data transactions. The platform’s supervision on data transactions should follow the principle of “inclusiveness and prudence”. It needs to conduct inclusive supervision on data sources and data quality, and prudently supervise data security and transaction subjects, so as to achieve the dual value objectives of maintaining transaction security and realizing free flow of data.
