新时代十年,中国环境法治建设取得了举世瞩目的历史性成就。以《中华人民共和国环境保护法》全面修订为标志,生态环境保护相关法律立改废步伐明显加快,环境立法体系基本建成;以环境执法体制机制改革为动力,各部门多措并举提升执法质效,环境执法取得长足发展;以环境司法专门化体系建设为契机,专门环境诉讼制度与传统诉讼制度发展良好,环境司法体系运行顺畅;以全球生态文明建设的重要参与者、贡献者、引领者为己任,积极推动可持续发展国家战略,在全球环境治理中的引领作用明显增强。党的二十大报告赋予了“人与自然和谐共生”在中国式现代化中的新定位,提出了在法治轨道上全面建设社会主义现代化国家的新要求。面对“生态环境保护任务依然艰巨”的严峻挑战,迫切需要准确把握党的二十大报告为环境法治建设所锚定的新方向,立足环境法典编纂研究取得的丰硕成果,继续扎实推进环境法典编纂工作,为构建“人与自然和谐共生的现代化”提供“良法”保障。

In the decade of the new era,China has made remarkable historic achievements in the construction of environmental rule of law.Marked by the comprehensive revision of the Environmental Protection Law of the People’s Republic of China,China has notably accelerated the pace of enacting,amending or repealing relevant laws on environmental protection,and has basically completed the environmental legislation system.With the reform of environmental law enforcement system and mechanism as the driving force,various departments have taken multiple measures to improve the quality and efficiency of law enforcement and made substantial progress in environmental law enforcement.With the construction of the specialized environmental judicial system as an opportunity,the specialized environmental litigation system and the traditional litigation system have developed well,and the environmental judicial system has been running smoothly.As an important participant,contributor and leader in the construction of global ecological civilization,China actively promotes the national strategy of sustainable development,and plays an increasingly leading role in global environmental governance.The Report to the 20th CPC National Congress gives a new position to“harmony between humanity and nature”in Chinese modernization,and puts forward the new requirements for building a modern socialist country in all respects under the rule of law.In the face of the severe challenge that“ecological conservation and environmental protection remain a formidable task”,it is urgent to accurately grasp the new direction anchored by the Report to the 20th CPC National Congress for the construction of environmental rule of law.Based on the fruitful results achieved in the studies of the codification of environmental law,it is essential to continue to make solid progress in the codification of environmental law to provide a“good law”for the construction of the“modernization of harmony between humanity and nature”.
