摘要
新中国成立初期,由于客观上的经济困难,加之劳资双方地位的发生新的变化,上海外资企业中劳资关系呈现紧张态势。为稳定经济和社会秩序,保证企业生产运营,上海市军管会一方面通过尽快出台相关法令,规范统一劳资争议的调处程序,明确争议的调解与仲裁机构;另一方面,积极探索整合外资企业中劳资关系的多项举措,推动创构了政府主导下以“发展生产、劳资两利”为核心的新型劳资关系。
In the early days of the founding of New China,due to the objective economic difficulties and the new changes in the status of both labor and capital,the relations between labor and capital in foreign-funded enterprises in Shanghai were tense.In order to stabilize the economic and social order and ensure the production and operation of enterprises,Shanghai Military Management Commission,on the one hand,standardized and unified the mediation procedures for labor disputes by issuing relevant laws and regulations as soon as possible,and defined the mediation and arbitration institutions for disputes;On the other hand,it actively explored a number of measures to integrate the relations between labor and capital in foreign-funded enterprises,and promoted the creation of a new type of relations between labor and capital under the leadership of the government with the core of“developing production and benefiting both labor and capital.”
