论推进村级组织负责人“一肩挑”的制度性优化

On Promoting the System Optimization of the“Multi-tasker”Village Organization Leaders

村党组织的领导与村民委员会的自治很大程度上决定着乡村治理的实际效果。村党组织书记通过法定程序担任村民委员会主任,是应对农村领导力不足、村“两委”职责行使不协调等乡村治理难题采取的针对性措施。村党组织书记担任村民委员会主任应当坚持遵循国家法律制度,依照法定程序,不能简单以行政命令方式妨碍村民自治。在“一肩挑”下,并不意味着村党组织书记和村民委员会主任在职责方面的简单混同,在乡村治理具体事务中也应当明晰界限。针对“一肩挑”之下二者出现的违法违纪行为,也应当区分违纪和违法,给予相应的惩处,发挥法治保障功能,维护法治权威。

The leadership of the village Party organization and the autonomy of the villagers’committee,to a great extent,determine the effect of village governance.The secretary of the village Party organization as the chairman of the villagers’committee through statutory procedures is a targeted measure taken to deal with rural governance problems such as insufficient rural leadership and uncoordinated exercise of the responsibilities of the“two committees”of the village.However,the secretary of the village Party organization as the chairman of the villagers’committee should adhere to the national legal system,and in accordance with legal procedures,cannot simply impede villagers’autonomy in the form of administrative orders.Moreover,in the“multi-tasker”system of village organization leaders,it does not mean that the village Party organization secretary and the villagers’committee chairman are simply the same in terms of responsibilities,and the boundaries should also be clear in the specific affairs of rural governance.Finally,in this“multi-tasker”system,with regard to the violations of the law and discipline,we should also distinguish violations of discipline and violation of the law,giving corresponding punishments to the village Party organization secretary and villagers’committee chairman that makes violations,so as to ensure the functioning of guaranteeing role of the rule of law,and maintain the authority of the rule of law.
