数字经济时代金融消费者保护新范式--基于监管沙盒模式的展开

New Paradigm of Financial Consumer Protection in the Era of Digital Economy:Based on the Regulatory Sandbox Model

监管沙盒以“让消费者受益”为新原则,以“穿透式”保护为新机制,以“专员化”为新方法,在金融科技创新产品或服务尚未投入市场前对金融消费者施行“积极介入式”保护。这是一种“前置型”、“矫正型”、“进取型”的保护,是监管沙盒以行为监管理论、分配正义理论和消费者主权理论为基础所形成的数字经济金融消费者保护新范式。中国版“监管沙盒”在金融消费者保护上的规定有待改进,为避免与国际消费者保护存在“制度时差”从而引发“市场壁垒”,应尽快在中国版“监管沙盒”中确立“让消费者受益”原则,精细化具体的金融消费者保护机制,渐进协同地在立法上实现纵横联动,完成数字经济时代金融消费者保护体系的后现代化升级。

Based on the new principle of“benefiting consumers”,the new mechanism of“penetrating”protection,and the new method of“commissionerization”,the regulatory sandbox implements“active intervention”protection for financial consumers before the fintech innovation products or services are put on the market.This is a kind of“pre-protection”,“corrective”and“aggressive”protection,which is a new paradigm of consumer protection in the digital economy and finance formed by the regulatory sandbox based on the theory of behavior supervision,the theory of distributive justice and the theory of consumer sovereignty.The provisions of the Chinese version of the“regulatory sandbox”on financial consumer protection need to be improved.In order to avoid the existence of“institutional jet lag”with international consumer protection and thus trigger“market barriers”,the principle of“benefiting consumers”should be established for China’s regulatory sandbox as soon as possible,the specific consumer protection mechanism should be improved,and the vertical and horizontal linkage should be realized in legislation,so as to complete the post-modernization and upgrading of the financial consumer protection system in the era of digital economy.
