数字法治政府建设背景下《行政许可法》的修改

Revision of Administrative License Law under the Background of the Construction of Digital Government Ruled by Law

数字法治政府建设促进政府、市场及社会三者关系重构,助推政府整体性治理及行政许可流程再造,改变行政许可法立法背景和实施环境,应围绕政府数字治理的特点修改《行政许可法》。应修改行政许可设定条件,从严限制行政许可设定,适当扩大设区的市设定行政许可的权限;建立全国统一的行政许可实施标准与程序,促进行政许可权从纵向、横向两个维度集中,逐步实现全国一体审批体制;保留行政许可依申请启动程序,赋予行政机关提示申请人启动许可申请的责任,申请人不再按照法律要求提供申请材料,而是依许可机关提示清单提供证明材料;建立许可机关和其他机关的协同审查机制,对行政许可申请材料实施协同审查和实质审查;建立适应数字法治政府的行政许可撤销、吊销和注销制度。

The construction of digital rule of law government promotes the reconstruction of the relationship between government, market and society, promotes the overall governance of the government and the reengineering of administrative licensing process, changes the legislative background and implementation environment of administrative licensing law,and should modify the administrative licensing law around the characteristics of government digital governance. Modify the conditions for setting administrative licenses,strictly restrict the setting of administrative licenses,and appropriately expand the authority of cities divided into districts to set administrative licenses;Establish national unified standards and procedures for the implementation of administrative licensing,promote the concentration of administrative licensing power from vertical and horizontal dimensions,and gradually realize the national integrated examination and approval system;Retain the principle of starting the administrative license according to the application,and give the administrative organ the responsibility to prompt the applicant to start the license application. The applicant will no longer provide the application materials according to the legal requirements,but provide the supporting materials according to the directory prompted by the licensing organ;Establish a collaborative review mechanism between the licensing authority and other authorities to implement collaborative review and substantive review of administrative license application materials;Establish an administrative license revocation,revocation and cancellation system suitable for digital government ruled by law.
