A Study of Countermeasures for Free Trade Ports with Chinese Characteristics from the Perspective of RCEP

《区域全面经济伙伴关系协定》(RCEP)自由、开放、便利、共享、包容的区域合作新理念,与中国特色自由贸易港自由便利制度精髓高度吻合。RCEP在跨境服务贸易、数字经贸、人员流动、海关监管等方面,促成海南自贸港更多新机遇。零关税、零补贴、零壁垒等经贸规则,使自贸港封关运作与RCEP形成叠加效应,成为多边贸易机制的共识,是建设具有世界影响力的中国特色自由贸易港根本特征,彰显海南自贸港构建开放型经济新机制新法治。对标RCEP经贸规则,构建自贸港法规体系,提升自贸港整体优势和国际竞争力,为我国未来加入CPTPP奠定制度先行基础,是自贸港法治创新目标。海南自贸港要以制度集成创新为核心,积极推动以国际化为特征的调法调规法治创新路径,推动更高水平开放,促进自贸港高质量发展,营造适应RCEP各成员国人文法治的自贸港市场化、国际化、法治化的一流营商环境。

The new concept of free,open,convenient,shared and inclusive regional cooperation in the Regional Comprehensive Economic Partnership Agreement(RCEP)is highly consistent with the essence of free and convenient system of free trade ports with Chinese characteristics.RCEP promotes more new opportunities for Hainan Free Trade Port in cross-border service trade,digital economy,personnel mobility,customs supervision,etc.Zero tariff,zero subsidy,zero barrier and other economic and trade rules come from the superposition effect of the customs closure operation of the free trade port and RCEP,which has become the consensus of the multilateral trade mechanism.It is the fundamental feature of building free trade ports with Chinese characteristics with world influence,and highlights Hainan Free Trade Port’s construction of new mechanism and new rule of law for open economy.Benchmarking RCEP’s economic and trade rules,building a legal system for the free trade port,improving the overall advantages and international competitiveness of the free trade port,and laying a system-first foundation for China’s future accession to the CPTPP are the legal innovation goals of the free trade port.Hainan Free Trade Port should take system integration innovation as the core,actively promote the law regulation and rule of law innovation path characterized by internationalization,promote a higher level of openness,promote the high-quality development of the free trade port,and create a market-oriented,international and legal first-class business environment for the free trade port that adapts to the rule of law in RCEP member countries.
