Research on Foreign Digital Economy Security Legislation

数字经济是继农业经济、工业经济之后的主要经济形态,是以数据资源为关键要素,以现代信息网络为主要载体,以信息通信技术融合应用、全要素数字化转型为重要推动力,促进公平与效率更加统一的新经济形态。习近平总书记指出:“数字经济发展速度之快、辐射范围之广、影响程度之深前所未有,正在成为重组全球要素资源、重塑全球经济结构、改变全球竞争格局的关键力量”。本文围绕世界主要国家和地区数字经济安全立法情况,在分析国外数字经济相关法律内容要点的基础上,从立法迫切性、前瞻性及重点关注领域等方面,立足法律法规安全保障体系搭建,从促进技术发展、搭建保障体系、规范数据管理、激发产业活力、加快安全治理等方面为数字经济立法提供建议,推动并保障数字经济安全平稳发展。

The digital economy is the main economic form after the agricultural economy and the industrial economy.It takes data resources as the key element,modern information networks as the main carrier,and the integration and application of information and communication technology and the digital transformation of all elements as important driving forces to promote fair and A new economic form with more unified efficiency.General Secretary Xi Jinping pointed out:“The rapid development of the digital economy,the wide range of radiation,and the unprecedented degree of influence are becoming a key force in reorganizing global factor resources,reshaping the global economic structure,and changing the global competition pattern”.This article focuses on the world’s major National and regional digital economy security legislation,based on the analysis of the key points of foreign digital economy-related laws,from the perspectives of legislative urgency,forward-looking and key areas of concern,based on the establishment of a legal and regulatory security system,comprehensive and multi-level,to provide suggestions on digital economy legislation from the aspects of promoting technological development,building a security system,standardizing data management,stimulating industrial vitality,and accelerating security governance,so as to promote and ensure the safe and stable development of the digital economy.
