人脸识别技术在商业活动中的应用与保护

Application and Protection of Face Recognition Technology in Business Activities

在商业活动中,人脸识别技术呈现出复杂性、大规模应用性等特点,人脸识别技术应用存在信息非法共享、技术缺陷等风险。近年来,人脸识别技术应用问题频发,《关于审理使用人脸识别技术处理个人信息相关民事案件适用法律若干问题的规定(法释[2021]15号)》的出台,在一定程度上缓解了人脸信息不必要收集问题,但人脸信息的保护仍需进一步完善。文中从54个违规人脸识别的执法案件入手,分析出目前人脸信息保护存在“知情同意规则”践行困难和监管缺位两大问题,并从公权力规制和行业自律两个角度为完善商业活动中的人脸信息保护提出了建议。

In commercial activities,face recognition technology presents complexity,largescale application and other characteristics,face recognition technology application has llgal information sharing,technical defects and other risks.In recent years,the application of face recognition technology problems frequently,“on the use of face recognition technology to handle personal information related civil cases applicable law on several issues(law[2021]15)”to a certain extent to alleviate the unnecessary collection of face information,but the protection of face information still needs to be further improved.Starting with 54 law enforcement cases of face recognition violations,this paper analyzes the two major problems of the existence of"informed consent rules"difficulties in practice and the absence of supervision in face information protection,and puts forward suggestions for improving face information protection in commercial activities from the perspective of public power regulation and industry self-regulation.
