论作为法治话语的“法律渊源”

On “Sources of Law” as a Discourse on the Rule of Law

法治话语是以塑造法治认同为目标的法学表达。将“法律渊源”这一法学术语作为法治话语,一方面是建构中国特色法治话语体系的时代需要,另一方面也是化解司法裁判必须援引法外规范这一可能诱发法治话语危机的现实诉求“。法律渊源”作为法治话语具有丰富的法理意涵,其既预设了语用视角的内部性,又预示了裁判规范来源的开放性,还预决了“所指”的制度事实属性“。法律渊源”作为法治话语具有多维功能,其不仅能为法律获取经验提供理论构造,为“据法裁判”观念提供证立依据,还能塑造法治运行的现实结构。

The rule of law discourse is a jurisprudential expression aimed at shaping the identity of the rule of law.The use of the jurisprudential term“legal source”as a rule of law discourse is,on the one hand,the need of the times to construct a rule of law discourse system with Chinese characteristics and,on the other hand,a practical demand to resolve the crisis of rule of law discourse that may be triggered by the need to invoke extra-legal norms in judicial decisions.The term“source of law”as a rule of law discourse has a rich jurisprudential connotation,which not only presupposes the internal nature of the discursive perspective,but also predicts the openness of the source of adjudicative norms,as well as the institutional factual properties of the“reference”.As a rule of law discourse,“sources of law”with a multidimensional function not only provides a theoretical construct for the acquisition of legal experience and a basis for the notion of“adjudication according to law”,but also shapes the realistic structure of the operation of the rule of law.
