中日数字贸易合作制度创新研究--以山东自贸试验区制度创新为视角

Research on the system innovation of Sino-Japanese digital trade cooperation--from the perspective of the system innovation in Shandong Pilot Free Trade Zone

山东省作为中国东部沿海省份,已构建了近20个双多边交流合作机制和平台,其中山东自贸试验区和全省共9个跨境电商综试区成为山东对日数字贸易合作的重要窗口。目前,中国除了加入业已生效的RCEP,还在积极申请加入CPTPP和DEPA,故山东自贸试验区的建设面临对标和对接“CPTPP+数字贸易规则”的机遇和挑战。日本在通过国内立法、参加数字贸易协定等方式不断强化自身数字贸易规则,以期拿到国际高标准规制制定的话语权。中日两国均构建了较为完备的数字贸易法治体系,但在双边合作过程中面临着数字贸易规则“碎片化”的“瓶颈”。山东省应以自贸试验区建设为契机,持续优化营商环境,深入推进数字服务出口基地建设和传统制造业数字化转型,努力创新技术型数字贸易模式,加速配套政策措施建设,完善多元化争议解决机制,不断深化对日数字贸易合作。

Shandong Province,as a coastal province in east China,has built nearly 20 bilateral and multilateral exchange and cooperation mechanisms and platforms,among which Shandong Pilot Free Trade Zone and nine comprehensive pilot cross-border e-commerce zones in the province have become important windows for Shandong’s digital trade cooperation with Japan.At present,in addition to joining the RCEP which has already taken effect,China is also actively applying to join the CPTPP and DEPA.Therefore,the construction of Shandong Pilot Free Trade Zone faces both opportunities and challenges of benchmarking itself against and matching“CPPP+digital trade rules”.Japan is constantly strengthening its own digital trade rules through domestic legislation and participation in digital trade agreements,so as to obtain the discourse power in the formulation of international high-standard regulations.Both China and Japan have built a relatively complete legal system of digital trade,but they are faced with the“bottleneck”of“fragmentation”of digital trade rules in the process of bilateral cooperation.Shandong Province should take the construction of the pilot free trade zone as an opportunity to continuously optimize the business environment,deeply promote the construction of digital service export base and the digital transformation of traditional manufacturing industry,strive to innovate the technology-based digital trade mode,accelerate the construction of supporting policies and measures,improve the diversified dispute resolution mechanism,and constantly deepen the digital trade cooperation with Japan.
