职务犯罪监察指导案例制度对于规范职务犯罪调查权的自由裁量、弥补监察法规释法不足具有重要意义。同时,该制度也是搭建“监察—司法”有效衔接的桥梁。当前行贿犯罪典型案例的适用罪名、指导内容和效力地位仅限于指引行贿犯罪的调查实践,尚不足为所有职务犯罪案件调查权的规范运行提供示范。监察机关对指导性案例的创制权应当具有垄断性,并在罪名认定等方面建立与最高司法机关联合发布案例的会商机制。基于职务犯罪调查权的权力特征,需要进一步区分指导性案例的不同类型及其效力。同时,从技术层面明确类案判断和参照适用的方式,推进调查阶段监察人员援引指导案例展开释法说理。

The guidance case system of duty-related crimes is of great significance for standardizing the discretion of the investigation power of duty-related crimes and making up for the lack of interpretation of supervision laws and regulations.At the same time,the system is also a bridge to building an effective connection between supervision procedure and judicial procedure.The applicable charges,guiding content and effectiveness status of model cases of bribery crime are limited to guiding the investigation practice of bribery crime,which is not enough to provide a model for the standardized operation of the investigation power of all duty crime cases.The supervisory authority should have a monopoly power on the creation of guiding cases,and establish a consultation mechanism with the highest judicial authority to jointly publish cases in terms of charge determination.Based on the power characteristics of duty crime investigation power,it is necessary to further distinguish the different types of guiding cases and their effectiveness.At the same time,from the technical perspective,the method of judging and referring to the application of similar cases is to be clarified,and the supervisors in the investigation stage are encouraged to cite the guiding cases to explain law and reason.
