规范与自主:民办高职院校监管政策制定的理论审思

摘要 民办高职院校监管政策制定应该立足于实现“政府监管”与“学校自主”的平衡。一方面,教育公共性是现代教育的基本特性,遵循教育公共性是民办高职教育发展的逻辑,而民办高职院校的公共性则提供了政府监管的合法性基础,需要政府支持民办高职院校建设,提升政府公共服务能力。另一方面,民办高职院校管理体制改革具有多元产权相互渗透的特点,民办高职院校的产权差异提供了尊重其办学自主权的合理性基础,产权结构也是影响其内部治理现代化的重要因素。对此,“公共价值”与“产权关系”应该是影响监管政策制定的重要因素。 The formulation of supervisory policies in private higher vocational colleges should be based on achieving a balance between“government supervision”and“school autonomy”.On the one hand,the publicity of education is the basic characteristic of modern education,and following the publicity of education is the logic of the development of private higher vocational education,while the publicity of private higher vocational colleges provides the legal basis of government supervision,which requires the government to support the construction of private higher vocational colleges and enhance the government’s public service capabilities.On the other hand,the reform of the management system of private higher vocational colleges is characterized by the mutual penetration of multiple property rights.The difference in property rights of private higher vocational colleges provides a reasonable basis for respecting their autonomy in running schools,and the structure of property rights is an important factor affecting the modernization of their internal governance.In this regard,“public value”and“property relationship”should be important factors affecting the formulation of supervisory policies.
