我国检察机关大数据法律监督制度研究

On the Legal Supervision System of Big Data in China′s Procuratorial Organs

数据资源是促进经济发展的重要引力,也是国家战略的助动力。自数字化技术与司法领域结合以来,大数据成为检察职能转变的关键契机,但作为新型技术,其为检察领域增添新活力的同时不可避免地存在数据壁垒问题严重、业务与技术融合度低、新型人才匮乏等实践问题。对此以大数据法律监督应用方式为技术基础,数字化技术在检察工作中的监督实效为实践基础,明晰大数据法律监督的对策研究,促进检察监督与数字化技术的相互融合成为最佳完善路径。

Data resources are an important gravitational force for economic development and an enabler of national strategies.Since the combination of digital technology and the judicial field,big data has become a key opportunity for the transformation of the procuratorial function.However,as a new technology,it adds new vitality to the procuratorial field while inevitably there are serious problems of data barriers,low integration of business and technology,lack of new talents and other practical problems.In this regard,the application of big data legal supervision is the technical basis,and the supervision effect of digital technology in the procuratorial work is the practical basis.The research on countermeasures of big data legal supervision is clarified,and the mutual integration of procuratorial supervision and digital technology is promoted as the best improvement path.
