在新时代语境下,“共同富裕”的内涵已然由聚焦演变为泛化,并呈现出全面性与系统性、公平性与效率性、长期性与渐近性、共建性与共享性等特质。《民法典》作为新时代国家民主法治的高度成就,具有丰富的共同富裕意涵,并从价值维度、规范维度和制度维度上推动了我国共同富裕的实现。在价值维度上,《民法典》为“共同富裕”提供了精神指引,这主要表现为培育社会力量,为共同富裕提供群体保障,发展市场经济,为共同富裕提供物质基础,健全权利体系,为共同富裕提供目的导向。在规范维度上,《民法典》为“共同富裕”提供了依据支撑,这主要表现为立法目的、立法原则以及立法体例与共同富裕的高度契合性。在制度维度上,《民法典》为“共同富裕”提供了机制保障,这主要表现为,《民法典》健全社会主义市场经济制度、弘扬社会主义核心价值观、完善民事生态环境保护规则,从而推动我国物质文明、精神文明与生态文明均衡发展。

In the context of the new era,the connotation of“common prosperity”has evolved from concentration to generalization,and presents characteristics such as comprehensive and systematic,fair and efficient,long-term and asymptotic,co-construction and sharing.As a high national achievement of democracy and rule of law in the new era,the Civil Code is rich in the connotation of common prosperity,and has constructed the discourse system of common prosperity in China from dimensions of value,norms and system.In the dimension of value,the Civil Code provides spiritual guidance for“common prosperity”,which is mainly manifested in cultivating civil society to provide group guarantee for common prosperity,developing market economy to provide material basis for common prosperity,and improving the system of rights to provide purpose guidance for common prosperity.In the normative dimension,the Civil Code provides the basis and support for“common prosperity”,which is mainly manifested as the high compatibility of legislative purpose,legislative principle and legislative style with common prosperity.And in the dimension of system,the Civil Code provide the mechanism guarantee for“common prosperity”,which is mainly manifested as that the Civil Code is establishing a sound system of socialist market economy,carrying forward the socialist core values and perfecting the civil rules of ecological environment protection,so as to promote the balanced development of material civilization,spiritual civilization and ecological civilization.
