版权网络侵权之“转移”规则研究

Research on the“transfer”rules of copyright network infringement

版权网络侵权行为能够给侵权人带来流量、粉丝以及商业广告收益和平台激励等间接利益,而现有的“通知-删除”规则作为平衡网络技术发展与权利保护的产物,虽然能够在一定程度上遏制版权网络侵权行为,但并不能对前述侵权人取得的间接利益进行规制。针对这种情况,以“通知-删除”规则为基础,尝试构建一种能够将该部分间接利益转移给权利人的“转移”规则,以期既实现对权利人应得利益的救济,也实现对侵权人侵权行为的规制。具体而言,“转移”规则依权利人向网络服务提供商申请而启动;“转移”的对象为间接利益,以是否具有经济收益划分为间接非经济利益和间接经济利益并作不同处理;“转移”过程中申请人、网络服务提供商和被申请人因所处地位的不同而承担不同的责任。

Copyright network infringement can bring indirect benefits such as traffic,fans,commercial advertising revenue and platform incentive benefits to the infringer.As a product of balancing the development of network technology and rights protection,the existing notification-delete rule can curb copyright network infringement to a certain extent,but it can not regulate the indirect benefits obtained by the infringer.In view of this situation,based on the notification-delete rule,this paper attempts to construct a“transfer”rule that can transfer the indirect interests to the obligee,in order to realize both the relief of the obligee's due interests and the regulation of the infringer's tort.Specifically,the“transfer”rule is started according to the application of the obligee to the network service provider.The object of“transfer”is indirect interests,which are divided into indirect non economic interests and indirect economic interests according to whether they have economic benefits or not,and treated differently.In the process of“transfer”,the applicant,the network service provider and the respondent bear different responsibilities due to their different positions.
