鹽型晶體發明是藥物晶型發明的一部分,針對鹽型晶體發明的無效宣告請求案幾乎佔藥物晶型發明無效案件的半壁江山,其創造性的判斷和舉证證明責任的分配與一般的晶型藥物發明有相似之處,也有細微差别。本文嘗試通過幾個案例,探討鹽型晶體發明創造性審查的思路。
