摘要
反向抵押制度是为解决“房产富有、现金贫困”的老年人“以房养老”问题而逐步孕育、发展和完善的一项住房抵押借款合同制度。反向抵押的称谓源于反向抵押借款合同中的借款、还款模式。反向抵押合同是以房屋评估价格、老年人年龄等因素为基础的最高额抵押合同。认为反向抵押的运行路径与一般抵押相反,把反向抵押权定性为一种不同于传统抵押权的新型抵押权,是对反向抵押制度的组成结构、各部分功能及其风险负担规则的误解。
The system of the reverse mortgage is gradually conceived, developed and perfected for solving the problem of “house-for-pension”. The name reverse mortgage comes from the mode of loanrepayment. The contract of a reverse mortgage is the maximum mortgage according to the appraisal value of the house and the age of the elderly. It is a misunderstanding of the structure, function, relevance and risk burden rules of the reverse mortgage system to define the reverse mortgage as a new mortgage different from the traditional mortgage.
