非法获取网络虚拟财产行为的刑法定性研究

对非法获取网络虚拟财产的行为应当如何定罪量刑,刑法并未明确规定,刑法理论界和实务界的争议焦点在于是定盗窃罪还是定非法获取计算机信息系统数据罪。实际上,这类犯罪中的受害人既有虚拟财产的拥有者又有运营商,受害人不同则影响该行为的定罪量刑。当受害人为虚拟财产的拥有者时,虚拟财产为该拥有者对运营商享有的的债权从而排除其财物属性,对行为人应定非法获取计算机信息系统数据罪;当受害人为运营商时,虚拟财产则具有财物属性,行为人的行为同时触犯数个罪名,即非法获取计算机信息系统数据罪和盗窃罪,在刑法理论上属于想象竞合犯,应从一重罪处断,即以盗窃罪论处。

The criminal law has not clearly stipulated how to convict and sentence the illegal acquisition of virtual property on the Internet.The focus of controversy between the theoretical and practical circles of criminal law is whether to convict the crime of theft or the crime of illegally acquiring computer information system data.In fact,there are both the owners and the operators of virtual property among the victims of this type of crimes,and the different victims will affect the conviction and sentencing of the behavior.When the victim is the owner of the virtual property,the virtual property is the creditor's right of the owner to the operator so as to exclude the property attribute,and the perpetrator should be convicted of illegally obtaining the data of the computer information system.When the victim is the operator,the virtual property has the property attribute,the perpetrator's behavior violates several crimes at the same time,that is,the crime of illegally obtaining the computer information system data and the crime of theft,so the perpetrator should be seen as imaginative?joinder?of?offenses in the theory of criminal law,and should be punished with a felony,that is,the crime of theft.
