“知识产权学”的学科体系建构

Constructing the Discipline System of“Intellectual Property Science”.

“知识产权”加上一个“学”字,可以引导人们关注“知识产权法”之外的其他知识领域,进而为建构知识产权学科提供理论支撑。“知识产权学”以知识产权法学为底色,以知识产权经济学、知识产权管理学、知识产权信息学、知识产权社会学、知识产权教育学、知识产权史学、知识产权哲学等为“四梁八柱”,共同构成“知识产权+”学科群体。以此为基础,从“知识产权学”理论体系和专门方法的形成、有关科学家群体的出现、有关研究机构和教学单位以及学术团体的建立并开展有效的活动、有关专著和出版物的问世等四个方面,加之行政和司法体系、法律政策体系、职业职称体系的现实策应,可以清晰呈现“知识产权学”的学科体系概略。

The term combining"intellectual property"(IP)with"science"shows its knowledge field well beyond"intellectual property law",thus providing theoretical support for the construction of intellectual property discipline."Intellectual property science",based on IP law,takes IP economics,IP management,IP informatics,IP sociology,IP pedagogy,IP history,and IP philosophy as its"main pillars",to form an"intellectual property+"discipline group.On this basis,the four underlying aspects,including the formation of the theoretical system and special methods of"intellectual property science",the emergence of relevant scientists,the establishment and effective activities of relevant research institutions,teaching units and academic groups,and the publication of relevant monographs and publications,are comprehensively established.In addition,the practical response of the administrative and judicial system,the legal policy system,and the professional title system are echoing on the ground of practicing.All these elements contribute to the systematic outline of"intellectual property science"as an academic discipline.
