摘要
“元宇宙”是虚拟现实技术支持下发展起来的一个全新概念,具有空间和技术的偏义性、演进性、探索性和前瞻性,是虚拟与现实的融合。元宇宙商业热潮给商标法律制度带来了地域性突破、商标标志虚拟语境化、商品和服务分类升级以及商标侵权判断跨空间化等一系列挑战。目前,商标法律制度可以通过思路转化、规则协调,解决元宇宙中的商标法律问题;但也需要对元宇宙技术背景下的商标制度重塑展开思考,以应对元宇宙中的商标管理和保护出现的特殊挑战。
"Metaverse"is a brand-new concept based on the virtual reality technology.Metaverse is a merging of virtuality and reality,with the attributes of space and technology subordinary,and is a looking-forward concept that keeps evolving and exploring.However,the boom of metaverse business has brought challenges to trademark regime,including breaking the principle of territoriality,contextualizing trademark signs into a virtual world,extending the classification of goods and services,and determination of trademark infringement across spaces.At present,trademark regime can modify current rules and regulations to solve these issues,but it's necessary to renovate the trademark regime in the context of metaverse in order to address challenges of trademark management and protection in future.
