论算法知情权与算法解释权再构造

Study on the Reconstruction of the Right to Information and the Right to Interpretation Algorithms

随着互联网技术的发展,与算法有关的法律问题成为热门研究课题。其中最具代表性的是算法知情权和算法解释权。目前,算法知情权与算法解释权并未在立法实践中获得同等地位。本文认为,相较于算法知情权,算法解释权因其必要性和可行性的不足而受到质疑,尚未见诸法典。然而,这并不意味着两者不能共存,通过明确算法解释的不同内涵,以算法主体区分算法知情权和算法解释权,也不失为一种进路。

With the advancement of the Internet,legal issues related to algorithms have become research hot spots.Among them,the most representative ones are the right to information and the right to interpretation.At present,the two have not received equal status in legislative practice.In this paper,it’s argued that the right to interpretation algorithm is questioned due to its lack of necessity and feasibility compared with the right to information algorithm,and has not yet been codified.Nevertheless,this does not mean that they cannot coexist.The two can be distinguished by clarifying the different connotations of the algorithm interpretation in terms of algorithmic subjects.
