国家管辖范围外海洋保护区与沿海国外大陆架权利的协调

Coordination between Marine Protected Areas beyond National Jurisdiction and Coastal States’ Rights upon the Outer Continental Shelf

国家管辖范围外生物多样性的养护是全球海洋治理领域的一项重要议题。作为保护海洋生态和生物多样性的有效措施,国家管辖范围外海洋保护区与沿海国外大陆架权利之间的冲突协调是当前BBNJ谈判所面临的现实问题。这一冲突的协调,既需要立足于现有的国际海洋法体系,以BBNJ谈判为契机,在“BBNJ协定”中建立国家管辖范围外海洋保护区与沿海国外大陆架权利冲突在程序上的协调机制;也需要跳出现有的海洋法体系,在海洋命运共同体视域下,构建符合海洋命运共同体理念的国家管辖范围外海洋保护区的管理制度,以主动与沿海国权利进行协调。

The conservation of biodiversity beyond national jurisdiction has been attracting the attention of the international community,and Area-based Management Tools,including marine protected areas,is an important issue in the process of BBNJ negotiations.As an effective measure to protect marine ecology and biodiversity,marine protected areas beyond national jurisdiction to certain extent conflictswith coastal states’ rights rest upon the outer continental shelf,and the coordination of such conflict has become a realistic problem to BBNJ negotiation.It is necessary to establish a procedural coordination mechanism in the BBNJ agreement based on the existing international law,to coordinate the conflict between marine protected areas beyond national jurisdiction and coastal states’ rights of the outer continental shelf.Also,in accordance with the idea of A Maritime Community with a Shared Future,it is also crucial to establish a proper management schemefor marine protected areas beyond national jurisdiction,so as to coordinate with the rights of coastal states actively.
